Terms and conditions

The following terms and conditions of sale are concluded between Audio Blast (SAS with a share capital of € 1000, whose registered office is at 48 rue Georges Meliès, 30000, Nîmes, France), registered with the Trade and Companies Register of Nîmes under the number TGI 825 081 466 hereinafter referred to as “Audio Blast” and managing the site https://audioblast.me and, any natural or legal person wishing to make a purchase via the website https://audioblast.me, hereinafter referred to as “the buyer”.

Article 1. Purpose
The present conditions of sale aim to define the contractual relations between Audio Blast SAS and the buyer, and the applicable conditions to any purchase made through the website https://audioblast.me. The acquisition of a product through this site implies an unreserved acceptance by the buyer of the present conditions of sale of which the buyer acknowledges having taken knowledge prior to his order. Before any transaction, the purchaser declares that the purchase of products on the site https://audioblast.me is for a strictly personal use and to have full legal capacity, allowing to act under these terms and conditions of sale.

Audio Blast SAS reserves the right to modify these sales conditions at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in effect at the date of the buyer’s order.

Article 2. Products
The products offered are those which appear on the site https://audioblast.me from the Audio Blast SAS company, within the limit of available stocks. Audio Blast SAS reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description containing its main technical characteristics. The photographs are as faithful as possible but not contractual.

Article 3. Prices
The prices shown on the product pages of the internet catalog are prices in Euros (€) including all taxes (VAT included for France) taking into account the VAT applicable on the day of the order. Any change in the rate of VAT may be reflected in the price of the products. Audio Blast SAS reserves the right to modify its prices at any time, provided, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. Prices shown do not include delivery charges, charged in addition to the price of the products purchased according to the total amount of the order.

Any change in the rate of VAT may be reflected in the price of the products. The amount of any sale, use, excise, import or export duty or other tax applicable to the manufacture, sale, or lease of Goods or provision of Service will be added to the invoice and must be paid by Buyer. Seller bears no responsibility for the amount associated with such taxes or duties. Buyer is responsible for all duties, sales and other taxes associated with the Order.

We accept payments in Euro and US Dollars. Prices include all taxes. For businesses within the European Union and outside France, VAT may be deduced from listed price during checkout.

Article 4. Order and terms of payment
Before any order, the buyer must create an account on the site https://audioblast.me. The account creation section can be accessed directly from the sidebar. At each visit, the buyer, if he wishes to order or to consult his account (order status, profile …), must identify himself with this information. The company Audio Blast SAS proposes to the buyer to order and regulate its products in several stages, with 2 payment options of the choice:

– Secure payment by Paypal or bank card (via PAYPAL system): the buyer selects the products he wishes to order in the “basket”, modifies order settings if necessary (quantities, references …), verifies the delivery address or informs a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, buyers choose their payment method: “Payment by Paypal”. The next step proposes to check all the information, to take cognizance and accept the present general conditions of sale by ticking the corresponding box and, then, invites the buyer to validate orders by clicking on the button “Confirm my order”. Finally, the buyer is redirected to the secure payment interface in order to securely inform Paypal account or personal credit card references . If the payment is accepted, the order is registered and the contract is definitely formed. Payment by Paypal or credit card is irrevocable. In case of fraudulent use of a credit card, the purchaser may demand the cancellation of the payment by card, the amount of money paid will be recreated or restored. The liability of the cardholder is not incurred if the disputed payment has been proven fraudulently, remotely, without physical use of his card. In order to obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have caused, the cardholder must, in writing, withdraw the debit from his bank within 70 days of the transaction or even 120 days If the contract to which it relates shall provide so.
Said amounts shall be reimbursed by the bank within a maximum period of one month after receipt of the written protest by the holder. No expenses of return of the sums can be charged to the holder.

Confirmation of an order entails acceptance of these conditions of sale, recognition of full knowledge and waiver of its own terms of purchase. All the data provided and the recorded confirmation will be proof of the transaction. If the buyer has an e-mail address and if he has filled in his order form, the Audio Blast SAS will send him by e-mail the confirmation of the registration of his order.

Article 5. Property
Audio Blast SAS retains full ownership of the products sold until the full collection of the prize, including principal, fees and taxes.

5.1 Software License
Software is subject to the separate software license agreement accompanying or made available to Buyer in connection with the software, in particular Seller’s End User License Agreement (“EULA”). In case of any discrepancies between the EULA and this Agreement, the EULA shall prevail.

The content on the seller’s website, https://audioblast.me, are protected by copyright and other intellectual and proprietary rights throughout the world. Unless they are expressly and unambiguously labeled as being for sale, or carry an express and unambiguous price tag, they are intended for demonstration purposes only (in particular, and not limited to, audio recordings, pictures, videos, and images). They may not be downloaded, modified, reproduced, distributed, publicly displayed, exploited, and/or used in any other way without the agreement from the seller.

Article 6. Retraction
According to article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for Exchange or refund without penalty, with the exception of return costs.

The product shall not be activated.

Article 7. Warranty
All the products supplied by the Audio Blast SAS company benefit from the legal warranty provided in articles 1641 and following of the French Civil Code. In case of non-conformity of a product sold, it can be returned to the company Audio Blast SAS which will take it back, exchange it or refund it, if not activated. All complaints, requests for exchange or refunds must be made by post to the following address: Audio Blast SAS, 48 rue Georges Meliès, 30000, Nîmes, France, within 30 days after delivery.

Article 8. Responsability
The Audio Blast SAS company in the process of distance selling, is held only by an obligation of means. Its responsability can not be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, rupture of the service, or other unintentional problems.

Article 9. Intellectual Property

All the elements from the site https://audioblast.me are and remain the intellectual and exclusive property of the Audio Blast SAS company. No one is allowed to reproduce, exploit, or use for any reason whatsoever, even partially, the elements of the site whether in the form of photo, logo, visual or text.

Article 10. Personal data
Audio Blast SAS is committed to preserving the information provided by the buyer, which he/she would have to transmit for the use of certain services. All information concerning buyers and users is subject to the provisions of French Law No. 78-17 of January 6th, 1978. As such, the user has the right to access, modify and delete information concerning him. Article 12. Settlement (in case of a litigation)
These terms and conditions of sale at a distance are subject to French law. For all disputes or litigation, the competent court will be the one from Nîmes, France.
